A meeting of the Working Group was held at the Agency for Strategic Reforms to study the issues of creating the Tashkent International Commercial Court (TICC) in Uzbekistan.
The event, chaired by the Director of the Agency B. Rakhmatov, was also attended by a legal expert from the Office of the Advisor to the President of Uzbekistan on Economic Development, Good Governance and International Cooperation Marie-Anne Birken, Deputy Minister of Investment, Industry and Trade B. Abidov, Head of the Department improving the investment climate and ratings of the Ministry of Investment, Industry and Trade A. Sim, head of the department of the Supreme Court Sh. Nazarov, judge of the Supreme Court I. Tadzhiev, interim Rector of the Tashkent State Law University I. Rustambekov, Director of the Tashkent International Arbitration Center D. Bayzakova, Chief Consultant of the Ministry of Justice A. Bekmirzaev, lawyer of the Centil Law company A. Dzhurazhonov and ASR employee A. Dekhkanov.
During the meeting, the parties noted that the creation of the Tashkent International Commercial Court would be an important step towards improving the business climate in the country. TICC will facilitate the consideration and quick resolution of commercial disputes, where one of the parties will be a non-residen t – a foreign person.
After a preliminary discussion of the draft Law “On the Tashkent International Commercial Court”, as well as the proposals of Mary-Ann Birken, representatives of ministries and departments pointed out the need to initially resolve conceptual issues, including the status of a commercial court in the judicial system of Uzbekistan, its jurisdiction, procedural provisions of its activities and mechanisms for its financing.
Based on the results of the working meeting, taking into account the opinions and proposals of interested parties, a decision was made to prepare in the ASR such documents as the draft Presidential Decree “On measures for the establishment of the Tashkent International Commercial Court” and the “road map” for its implementation, as well as a comparative table for the project The Law “On the Tashkent International Commercial Court” with specific editions of the articles and justifications.
